Russia proposes to create a post of ombudsman for wild animals

The head of Rosprirodnadzor, Svetlana Radionova, suggested creating a office of ombudsman, who will specialize in protecting the rights of wild animals.

Strengthening public control over the rescue of wild animals will contribute to the harmonization of relations between wild animals and humans. This position was voiced by the chairman of "Business Russia" Alexei Repik. He reminded, that the responsibility for poaching and illegal business has been tightened, created a system of rehabilitation and reintroduction. Through rescued animals, improved health and trained for life in the wild, the population of unique individuals is being restored in many regions of the Russian Federation.

Finding new effective ways to save the environment, reducing poaching and saving endangered species from climate change requires additional adjustments in the current legislation.

“First of all, it is necessary to define the conceptual and categorical apparatus of the four federal laws, that govern the rescue, rehabilitation and reintroduction of wild animals: No. 498-FZ "On the responsible treatment of animals and on amendments to certain legislative acts of the Russian Federation", No. 52-FZ "On the animal world", No. 209-FZ "On hunting and the conservation of hunting resources and on amendments to certain legislative acts of the Russian Federation" and No. 166-FZ "On fishing and the conservation of aquatic biological resources". The next step is important to eliminate conflicts of law”, - emphasized a member of the General Council of "Business Russia", Head of the Expert Center for Criminal Law Policy and Enforcement of Judicial Acts Ekaterina Avdeeva.

Ekaterina Avdeeva paid special attention to the need to introduce the special status of “Rescued Animal” into the scope of the current Federal Law No. 498-FZ and the Center for Rescue and Rehabilitation, subdivided into categories.

“At the same time, we consider it expedient to regulate the measures of responsibility, one side, toughening penalties for illegal acts against wild animals and, on the other hand, making exceptions to the disposition of art. 258.1 CC RF, if urgent actions are taken with Red Book animals to save them, in order to exclude the prosecution of conscientious animal defenders, who provide real help. Delovaya Rossiya is ready to comprehensively join the work on the legal regulation of the issues of confiscation and rehabilitation of wild animals, ensuring the proper level of public control, as well as join the formation of legislative initiatives. The implementation of legislative initiatives should take place in close interagency cooperation with the participation of public associations and the scientific community, and also take into account the characteristics of each specific region, where they will be applied. Our task is to discuss and propose a rational mechanism for improving the efficiency of protecting wild animals at all stages of rescue.. The main criteria for evaluating the measures discussed today should be their accessibility, efficiency and complexity", – concluded Ekaterina Avdeeva, expressing deep respect for people, who at their own expense, engage in animal protection at their own peril and risk.
