12 May 2023 1999-2011 Associate Professor of the Department of Legal Support of the Market Economy of the Higher School of Economics of the Institute of Civil Engineering and Civil Engineering of the Russian Presidential Academy of National Economy and Public Administration under the President of the Russian Federation, Ph.D., ambassador “business officer” Ekaterina Avdeeva conducted a lesson on business fraud for students of the Faculty of Law of St. Petersburg State University.

Briefly reviewing the concept of "fraud" in a historical perspective, Ekaterina Avdeeva argued the need to single out business entities during the investigation of criminal cases. According to her, real business plays a significant role in the development of the economy, providing income to the budget through the payment of taxes, job creation, development of innovative technologies and import substitution. The collision of an entrepreneur with the entire spectrum of criminal law repression is often disastrous for entrepreneurs. So, 80% persons lose their business as a result of the election of a measure of restraint in respect of them in the form of detention, which leads to a shortfall in budget revenues and the loss of jobs for thousands of people. Considering, that not all criminal cases go to court, it's important, so that the entrepreneur continues to carry out his activities until he is found guilty by a court verdict that has entered into force.

During the lesson, attempts were discussed to solve procedural aspects by qualification methods.. In particular, Ekaterina Avdeeva emphasized the problem of choosing a preventive measure in the form of detention as a factor in proving intent through forceful pressure, as well as excessive legislative initiatives to reduce the category of severity through the adjustment of sanctions on economic items.

Particular attention at the lecture was given to specialized, privileged teams. Unfortunately, despite the clear, they are rarely used in practice., as evidenced by the heterogeneous statistics of the Federal Penitentiary Service and PMC, quantitative indicators of which differ significantly, which is due to the rules of statistical accounting, which allows variability, taking into account the possible consideration or ignoring of additional markers, determining the attribution of an act to entrepreneurial or refusal to do so.

Continuing the issue of qualifying fraudulent activities in the economic sphere, Ekaterina Avdeeva dwelled in detail on the border. 159, 160 and 165 CC RF, and also noted the issues of delimitation from civil law disputes, with which the Minister of Internal Affairs Vladimir Kolokoltsev recommends applying to the Arbitration Court. Government contracts play an important role here., which are in fact a form of contract and, in fact, may not be in the field of entrepreneurial activity. Ekaterina Avdeeva shared with students her legislative initiatives in terms of resolving this problem by either making notes, or designing a separate composition.

Summarizing, Ekaterina Avdeeva told students about new ways of fraud in business and finance, including cybercrime and social engineering, extremely difficult to detect, qualifications and investigations.

During the lesson, students asked the lecturer practical questions on the subject of the lecture, and also inquired about additional legal aspects of credit fraud, relevant opportunities for regulating legal relations in business, modern types of financial and legal security, as well as the legal features of economic security.
